(1) A person who has obtained citizenship of a foreign country and resides in a country outside the member countries of the South Asian Regional Cooperation Organization and who is a citizen of Nepal on the basis of firstborn or his father or mother, father or mother, who later obtained citizenship of a foreign country, is entitled to enjoy economic, social and cultural rights. Will be able to get resident Nepalese citizenship (2)- According to sub-section (1), a person who wants to get non-residential Nepali citizenship should submit an application as prescribed before the designated authority with the following documents attached:-
(a) Proof that the person making the application or his father, mother, grandfather or grandmother is a citizen of the country of origin,
(b) Proof of relinquishment of citizenship if the concerned person has acquired the citizenship of the previous state (c) Proof of citizenship of a foreign country,
(d) proof of residence in a country other than a member country of the South Asian Regional Cooperation Organization,
(e) Nepal: Letter of commitment to comply with the constitution and laws.
(3) In previous case: Non-resident Nepali who has not returned the citizenship certificate after taking Nepali citizenship: When applying for citizenship according to sub-section (2), he must also submit the previously obtained Nepali citizenship certificate.
(4) After receiving the application according to sub-section (2), the designated authority will grant the non-residential Nepalese citizenship as prescribed after providing all necessary evidence.
(5) According to sub-section (4), a person who has obtained non-resident Nepali citizenship must take an oath as prescribed.
(6) If a person who has obtained non-residential Nepali citizenship according to this section obtains such citizenship by giving false information, or if it is determined that he has acted contrary to the independence, sovereignty, geographical integrity and national interest of Nepal, the Government of Nepal will cancel the non-residential Nepali citizenship obtained by such a person.
